GENERAL TERMS AND DEFINITIONS:
"MASSAGE" means treatment of the superficial parts of the human body by rubbing, pressing, stroking, kneading, tapping, pounding, bathing, vibrating, manipulating or stimulating with the hand(s) or any instrument, for an economic consideration.
"MASSAGE THERAPIST" means any person who massages; but it does not include:
- Any individual licensed to practice any "healing art" under the provisions of Division 2, commencing with Section 500, of the California Business and Professions Code while engaging in practice within the scope of their license; or
- Barbers, cosmetologists, estheticians, manicurists, electrologists, or other individuals licensed under Chapter 10 of Division 3, commencing with Section 7300 of the California Business and Professions Code while engaging in practice within the scope of their license.
"MASSAGE ESTABLISHMENT" means any premises where massage is given, either as a primary or secondary function.
"OUTCALL MASSAGE SERVICE" means massage given other than in a massage establishment.
"EMPLOYEE" means any person working for the permittee of a massage parlor or outcall massage service.
"OPERATE" and "OPERATOR" refers to operating, conducting, maintaining, or allowing a massage parlor or outcall massage service, or employing a massage therapist to serve others.
PERMITS REQUIRED:
- "OPERATOR PERMIT" No person shall operate or allow the operation of a massage parlor or an outcall massage service without a valid permit.
- "MASSAGE THERAPIST PERMIT" No person shall act as a massage therapist, nor shall anyone employ a person as a massage therapist/masseuse for others, who does no have a valid massage therapist permit. Every operator shall maintain a register of all persons so employed and their permit numbers, which register shall be available for inspection by the Chief of Police, during regular business hours.
PERMIT EXEMPTIONS:
Special Note: Certain professions are exempt from the requirements of this ordinance
Any individual licensed to practice any healing art under the provision of Division 2, commencing with Section 500, of the California Business and Professions Code while engaging in practice within the scope of their license.
